Vaahs' win landmark lawsuit against Lister Hospital

The Teshie based couple, who accused staff of Lister Hospital and Fertility Center of incompetence and negligence, leading to the death of their only son at birth, have won a landmark lawsuit, setting the stage for a multimillion cedi lawsuit the couple intends bringing against the Hospital in their quest for justice.

Mr. and Mrs. Vaah sued Lister Hospital at an Accra Fast Track High Court for refusing to release the medical records of Mrs. Elizabeth Vaah, citing adverse comments she was quoted as having made in the media about the poor services rendered her at the Hospital considered one of Accra’s finest.

Although the Hospital subsequently released Mrs Vaah’s medical records after the Court begun hearing the case, the Vaah’s insisted that the Judge made a landmark ruling that should guide hospitals in their future relationship with patients.

In a landmark ruling delivered on Thursday July 29, Justice P Derry, said the Hospital’s reasons for hitherto withholding the medical records of Mrs. Vaah was baseless, citing various provisions of the 1992 Constitution and a number of authorities outside Ghana.

Speaking to Citi News, Lawyer for the Vaahs, Lawyer Edward Amuzu, said by the Human Rights Court ruling, no hospital shall have the right to withhold any patient’s medical records, unless there are legally tenable reasonable to do so.

Lister Hospital has however not given any indication of appealing the court ruling. Mrs Elizabeth Vaah lost what was to be her last baby, Nyilale Vaah Junior, at the Lister Hospital in March this year, under questionable circumstances.

She and her husband, Thomas, have blamed negligence on the part of medical staff of the hospital for the death of their newly born baby, but the Hospital has vehemently denied the charge.

The Couple have publicly said they will do everything legally possible to get justice for their dead son.
In the meantime, they have set up an NGO known as the Vaah Junior Foundation to lead the crusade for better maternal care for all Ghanaian women.
