Charge homosexuals with genocide – Sam P. Yalley
A Public Interest lawyer and former deputy minister under the Rawlings administration Mr.
Sam Pee Yalley is proposing that persons arrested for acts of homosexuality should be charged not only with the provisions of the country’s constitution but with genocide.
According to him, the act of homosexuality just as genocide, exterminates the concept of procreation.
Sam Pee Yalley made this proposal on Citi Eyewitness News on Wednesday August 31 when he was contributing to the debate on Ghana’s stance on homosexuality which the Attorney General Martin Amidu has said is not illegal.
The Attorney General's comments sort to clarify Ghana’s position on the much talked about issue of homosexuality where he asserted that homosexual acts between two consenting adults, per Ghana’s laws, is not illegal so far as it is confined to the privacy of the partners' bedroom.
These comments drew sharp condemnation from the Moderator of the General Assembly of the Presbyterian Church of Ghana Rev.
Emmanuel Martey who described them as “illogical and unfortunate”.
Sam Pee Yalley said that “for me there is another session of the criminal code which people are not taking a look at, it is about genocide.
“Genocide results in the extermination of the human race and if you expand the meaning of homosexuality to mean that a man cannot have a child with another man then it means that that practice would lead to the extermination of mankind and therefore for me if i am to charge anybody apart from having unnatural carnal knowledge, i would also charge him with genocide and see how he can get out of that situation.
“If you are a man and you are having canal knowledge with a man how are you going to have a child?
“I agree totally with the clergy in condemning it.
He went on further to say that “genocide is not only about war crimes, it is about any act or practice that seeks to exterminate the human race either by ethnic or sect so if you do anything that seeks to exterminate the human race because sect or religion then that is genocide.
“So if you decide that you are going to have sex with our male counterparts, how will the world be re-procreating?
Sam Pee Yalley’s proposal has brought a new twist to the debate on homosexuality but the proposal has also been shot down by his fellow legal practitioner John Ndebugri who is a former Member of Parliament for Zebilla.
According to Mr.
Ndebugri, the concept of genocide is “rather farfetched and we may be misleading the public if we are to stretch things that far”
